“Advertisement/Vehicle Inspection Report” means the information posted on the Website as a result of You ordering Our Premium Package, Standard Package, Basic Package or Vehicle Inspection service.
"178 Point Check" means the vehicle inspection carried out as part of Our Premium Package or Vehicle Inspection service.
"Buyer" means an individual who is sourcing a vehicle from this website.
"Seller" means an individual who is advertising a vehicle as being for sale on this website.
"Site Users" means anyone using this website
These terms and conditions and our services to You are governed by English law.
Our Premium Package Service and Vehicle Inspection Service are offered for You only and do not undertake to provide witness statements and or reports in any civil proceedings

CONDITIONS APPLICABLE
Unless agreed by Us in writing 178 point check shall not be deemed to incorporate any opinion expressed by Us in relation to vehicle values or rectification or repair costs. Any estimates for repair/rectification or values given by the engineer are a subjective opinion and are given solely as a matter of goodwill.
Any times given for the appointment and duration 178 point check are approximate only and can vary from one vehicle to another. We cannot accept liability for any reasonable delay or extended duration.

ONLINE MESSAGE SYSTEM
The online message system is freely available to all site users who create a profile thus registering a username (email address) and password.
The message system is solely for the purpose of providing a secure contact between Buyers and Sellers regarding the purchase or sale of the vehicle advertised and should not be used for spamming or any commercial contact.
The content of messages should not be offensive, threatening or obscene.
Any content sent in a message in breech of term 15 will be removed without notice and may result in Your access to Our services being removed and where applicable no refund will be given. Any content placed on the site by You that is illegal will result in prosecution under the laws of England.
We are under no liability for the content or authenticity of any messages sent by site users.

INCLUSIVE TEXT MESSAGES.
Premium Package, Standard Package and Vehicle Inspection customers are provided with text (SMS) alerts free of charge and/or are included in these services.
Any unused text (SMS) messages provided free of charge and/or included in these services can not be exchanged or transferred to other services nor can they be redeemed for a refund.
Any text (SMS) message sent to Us by You from Your mobile phone in conjunction with any services listed above will be charged for by Your network service provider at your standard network rate.

178 Point Check Vehicle inspection
We will carry out as part of Our Premium Package and Vehicle Inspection service Our 178 point vehicle inspection. Our inspection consists of a visual, external and internal check on the vehicle you have registered to be inspected and does not include fault diagnosis, or any dismantling or removal of parts. In total we will check up to 178 aspects of the vehicle, depending on the make and model of the vehicle to be inspected. If a test drive is included in your 178 Point Check, we will conduct a test drive of up to 5 miles.
Due to the subjective visual nature of our 178 Point Check, it may not be possible to carry out all checks in all cases. In the event that we are unable to carry out any part of the 178 Point Check due to circumstances beyond Our reasonable control or because you have not carried out your responsibilities under paragraph 26 below, we will not refund any part of the Chosen service fee. In such cases any part not inspected will be reported on the Advertisement/Report as unchecked. Provided that where we have been unable to carry out the entire 178 Point Check and we reasonably consider, at our sole discretion, that this was due to no fault on your part, we may offer to carry out the 178 Point Check on an alternative date at no additional cost.
We do not analyse, dismantle or remove any part or component or mechanism from the vehicle when carrying out the 178 Point Check and therefore we do not accept liability for defects which arise in any part of the vehicle which is not included in our 178 Point Check, or not reasonably apparent or capable of identification at the time of 178 Point Check, nor for latent defects which are later discovered, nor for defects which arise after the 178 Point Check if they were not reasonably detectable at the time the 178 Point Check was carried out.
Your 178 Point Check does not replace manufacturer or other servicing or maintenance requirements or any legal checks (including without limit MOT). Your vehicle will not be checked for compliance with Construction and Use Regulations nor with the requirements of qualified bodies such as DPTAC. Your 178 Point Check does not include stress or weight tests on any part of your vehicle including, without limit: seat fitting, belt, strap, grab rails, mountings, harness or adaptation, or their security. We do not examine fire extinguishers or their functionality or the contents of first aid kits.
We are unable to verify the accuracy of the vehicle’s mileometer reading and can only report the mileage reading.
We are unable to offer our Premium Package or Vehicle Inspection service for commercial vehicles.
To carry out the 178 Point Check we require, and it is your responsibility to arrange, the following (and you agree that if you fail to arrange for these to be available it may restrict the scope of the 178 Point Check and that the full Premium Package or Vehicle Inspection Service fee will remain payable)

The keys to the vehicle

The vehicle will be located on a hard, level surface off the public highway – if this is not possible, the 178 Point Check may be restricted
The vehicle present at the arranged time at the address provided in address 1 or 2 at the time of ordering Our Premium Package or Vehicle Inspection service and ready for inspection
For best results the use of a lift or pit. (If neither is available we will use a jack but the 178 Point Check may be restricted) classic, high performance, prestige and vehicles over 15 years old will require the use of a lift or ramp or pit at all times.
Please notify us at the time of Order in the special requirements section on the Premium Package or Vehicle Inspection Service order form, the reference number you where given if/when you made a Prestige service enquiry due to the vehicle being convertible, over 15 years old, a prestige/classic or high performance vehicle, non-standard vehicle or a 4x4. (Failure to do so may result in our being unable to carry out the 178 Point Check either in full or part). If we are required to arrange for the use a ramp of a lift or pit at a local garage to enable us to carry out the 178 Point Check, We reserve the right to pass any additional charge on to You.
178 Point Check during daylight hours in good weather conditions. Poor weather conditions or visibility may mean the 178 Point Check is restricted
The vehicle to be in a reasonably clean condition
The vehicle to be in a roadworthy and driveable condition
A valid MOT Certificate (where applicable) and the vehicle’s DVLA registration documents should also be available for inspection.

It is your responsibility to provide accurate information and written documentation in the form of purchase receipts for any repair work carried out and any parts fitted and/or replaced.

ADVERTISEMENT AND INSPECTION REPORT HOSTING
Any content placed on the Website by You that is to be deemed by us as unacceptable for a general viewing audience or deemed by Us to be offensive, will be removed without notice and where applicable no refund will be given. Any content placed on the site by You that is illegal will result in prosecution by the laws of England.
In the case of the Premium Package, Adverts will be uploaded to the Web Site by Us within a reasonable time after the 178 point check and Test Drive have been completed (typically 24 hours). We will not be held liable for any reasonable delay in upload of your advertisement including any electronic equipment or software failure within our system and that of any third party involved in the completion of our services.
By ordering the 'Premium Package' service you agree to the stated details of the 178 point inspection and test drive to be displayed on the website to be viewed by any site user.
By ordering the 'Vehicle Inspection' service for any vehicles advertised on the site through the Easy Order Inspection facility you agree to the stated details of the 178 point inspection and test drive to be available for resale by Us to any site user if the vehicle is not listed as sold within 3 days of the inspection report being uploaded to the website.
We are not liable for any consequential loss incurred as a result of any of the information from the checks involved in the conduct of our services being displayed on the website.
From the time of upload by Us or You Your advertisement or report will be placed on our website in the area stated in the terms of service until removed by You or removed by Us should any advertisement be in breach of these terms and conditions.
No changes should be added to the Post Inspection Changes section of a Premium Package Advert without documentary evidence to verify the changes. (Documentary evidence should be made available for any potential buyer)
The content of the advertisement will be as described and conform with the details displayed on the Web Site. We reserve the right to change the Advertisement format and content without notice.
All contents of a Premium advertisement is correct at the time the 178 point check was carried out.
We reserve the right to remove any advertisement after 90 days which is no longer responding to contact through the message system and/or any contact numbers placed on the advert for a continuous period of 15 days beginning the day a request response message is sent by Us. Failure to respond to any contact through the message system and/or any contact numbers placed on the advert for a continuous period of 15 days will deem the vehicle as no longer for sale. Any advertisement removed in this instance will not be eligible for a refund.
If an advertisement is removed by Us as described above you may request the vehicle be re-listed free of charge within 5 working days of the advertisement being removed.
We reserve the right to remove any advertisement should You be in breach of these terms and conditions any advertisement removed in this instance will not be eligible for a refund.

CANCELLATION

You may cancel your Premium Package or Vehicle Inspection service in writing at any time within seven working days beginning the day after the date on which you have made a booking, for a full refund except

Where you cancel within 24 hours of the 178 Point Check and in such circumstances, you will not be entitled to any refund

Vehicle Inspection Guarantees And Liabilities

We warrant that the 178 point check will be carried out with reasonable skill and care. Any warranty or guarantee given by Us in respect of the 178 point check shall be subject to the following conditions:
a) We shall not be responsible for verifying the accuracy of odometer readings or confirming the service history of any vehicle.
b) We shall be under no liability or in any way responsible for any defects which would not have been apparent on the inspection of the vehicle.
c) We shall be under no liability in respect of any defect arising from wear and tear or where, at the date of inspection, performance of the item was satisfactory.
d) We shall be under no liability in respect of any opinion expressed by Us as to the likely costs of any repairs or costs of rectification (and any such opinions expressed by Us shall not be deemed to be comprised in the 178 point check).
e) We shall be under no liability under any condition, warranty or guarantee if the Fee has not been paid.
f) We shall not be liable to You for any loss of profits, economic loss and loss of goodwill (whether direct or indirect) or for any indirect, purely economic losses incurred as a result of or in connection with any 178 point check whether resulting from breach of contract, negligence, breach of statutory duty or otherwise.
g) Our liability hereunder for any delay in performing or any failure to perform any of Our obligations in relation to the 178 point Check shall be limited to the excess (if any) of the cost to You in the cheapest available market to replace the services not performed.
Nothing in these Conditions is intended to nor shall it limit any liability on Our part in respect of death or personal injury caused by Our negligence.
Where You are dealing as a consumer Your statutory rights are not affected by these Conditions.

GENERAL

If any provisions of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provisions in question shall not be affected. thereby.

Any notice given hereunder must be given in writing and delivered or sent by post or facsimile transmission to the residence or principal place of business of the party to whom it is addressed.

Except as otherwise provided nothing in this Contract shall confer on any third party any benefit or the right to enforce any terms of this Contract.

These Terms and Conditions are governed by and shall be construed in accordance with the laws of England and Wales and any dispute in relation to them shall be subject to the non-exclusive jurisdiction of the courts in England and Wales.
